End User Licence Agreement

1. The Agreement

This End User Licence Agreement ("EULA") is a legal agreement between you and Dumitru Vasiliu ("we," "us," the "Licensor"), publishing as part of the TimrX portfolio, governing your use of the Network Infrastructure Trainer application and any related content and updates ("the App"). By installing or using the App you agree to this EULA. It supplements our Terms of Use and Privacy Policy.

2. Grant of Licence

We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to download and install the App and use it for your own personal, non-commercial training and educational purposes, on any device that you own or control and as permitted by the App Store Rules of the store you obtained it from.

3. Licence Restrictions

Except to the extent permitted by applicable law, you must not:

• Copy, modify, adapt, translate, or create derivative works of the App
• Rent, lease, lend, sell, sublicense, distribute, or otherwise transfer the App
• Reverse engineer, decompile, or disassemble the App, or attempt to derive its source code
• Remove, obscure, or alter any proprietary notices in the App
• Use the App in any unlawful way or to develop a competing product

4. Ownership

The App is licensed, not sold, to you. We and our licensors retain all right, title, and interest in and to the App, including all intellectual property rights. You receive no rights other than the licence expressly granted in this EULA.

5. Updates

We may release updates, bug fixes, or new versions of the App. Depending on your device settings, updates may be downloaded and installed automatically. This EULA applies to all such updates unless a separate agreement accompanies them.

6. App Store Terms

Your use of the App is also subject to the usage rules and terms of the platform from which you downloaded it (the "App Store Rules"), including those of Apple and Google. If this EULA conflicts with the App Store Rules, the App Store Rules will prevail to the extent of the conflict for that platform.

7. Apple-Specific Terms

If you obtained the App from the Apple App Store, the following applies:

• This EULA is between you and us only, not with Apple. Apple is not responsible for the App or its content.
• Apple has no obligation to provide maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); Apple has no other warranty obligation regarding the App.
• Apple is not responsible for addressing any claims relating to the App, including product liability, legal/regulatory non-compliance, or consumer protection claims.
• Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.

9. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential loss arising out of or related to your use of the App. Nothing in this EULA excludes or limits liability that cannot be excluded by law, including for death or personal injury caused by negligence, or for fraud.

10. Term & Termination

This EULA is effective until terminated. It terminates automatically if you breach any of its terms. On termination you must stop using the App and delete all copies. Sections that by their nature should survive (including ownership, warranty disclaimers, and limitation of liability) will continue to apply.

11. Governing Law

This EULA is governed by the laws of England and Wales, without affecting any mandatory consumer protection rights available to you in your country of residence.
